Insurance Claims (Bad Faith)

Bad faith liability in the insurance context – also known as breach of the duty of good faith and fair dealing, arises from the contractual relationship between the insured and the insurer.

The duty of good faith and fair dealing is separate and distinct from the insurer’s settlement duties that arise under the Insurance Code.  Because the duty of good faith and fair dealing arise from, but is independent of, the insurance policy, causes of action for breach of contract and breach of the duty of good faith and fair dealing are also separate and distinct actions.

If you have made a claim on an insurance policy and the insurance company has denied the claim or has delayed payment on the claim when liability was reasonably clear, or the insurance company has cancelled an insurance policy without a reasonable basis, you may have a claim against the insurance company.
